$1,250,000
Cyclist Doored by Commercial Vehicle
Injuries: Cervical spine injury requiring two-level fusion, thigh hematoma with surgery and infection, right shoulder surgery, right hip labral tear, permanent pain and disability
Amount of Settlement: $1,250,000
Overview
Our client, an experienced cyclist, suffered life-altering injuries when the driver of a commercial vehicle suddenly opened his door into the bike lane. The collision threw our client over his handlebars, causing multiple traumatic injuries, permanent disabilities, and profound disruption to his life. After litigation and mediation, the case was successfully resolved for $1,250,000.
The Collision
While riding lawfully in a designated bicycle lane, our client was struck by a car door abruptly opened into his path. With no opportunity to avoid impact, he was launched to the ground and sustained catastrophic injuries.
Severe Injuries and Medical Complications
Thigh Injury
Immediately after the crash, our client’s right thigh swelled dangerously, leading to ICU admission for fear of compartment syndrome. Surgery was required to evacuate a large hematoma. Complications arose when the wound became infected, prolonging recovery and leaving permanent scarring, numbness, and chronic pain.
Shoulder & Hip Injuries
Our client’s right shoulder required arthroscopic surgery following months of failed conservative treatment. Despite extensive rehabilitation, he continues to experience limitations. He also developed a right hip labral tear, further restricting mobility and compounding his disability.
Neck Surgery
Most serious was the cervical spine injury. Progressive neurological deficits necessitated a two-level cervical fusion. During surgery, uncontrolled bleeding caused a dangerous airway emergency, requiring an urgent second operation with awake intubation. Though the procedure stabilized his condition, our client was left with lasting pain, reduced range of motion, and permanent impairment.
Proving Liability
At his deposition, the commercial driver denied opening his door into the cyclist. However, audio recordings from the company’s dispatch system captured him admitting immediately after the crash: “I just opened my door and hit a bicyclist.” This powerful contradiction undermined the defense and secured a strong liability position for our client.
The Resolution
Facing the strength of the liability evidence and the scope of the damages, the defense agreed to resolve the case at mediation for $1,250,000.
Protecting the Rights of Cyclists
This case demonstrates the devastating consequences of negligent conduct around cyclists and the importance of aggressive advocacy in holding commercial drivers accountable. Our client obtained the resources needed to secure ongoing care and financial stability after an event that forever changed his life.
