Recent Personal Injury and Wrongful Death Awards in Western Massachusetts

Several significant personal injury verdicts and settlements have come out of the Springfield region over the past decade. In 2010, a 43-year-old woman was tragically killed inside a Cumberland Farms store at Grove and Front streets in Chicopee, when a SUV driver slammed into the building. The driver, who reportedly suffered a stroke, had been speeding more than 70 mph, according to Masslive.com, the local news website.

The woman’s family filed a wrongful death lawsuit against Cumberland Farms Inc., claiming the site should have been protected by barriers. In February 2016, when the case went to trial in Hampden Superior Court, the jury ordered the national chain to pay $32.3 million in damages. But this did not stand. In August 2016, a Hampden Superior Court judge reduced the award to $20 million.

Masslive.com reported the $32.3 award may have been the largest award in Hampden County. But another jury in Hampden Superior Court came close a few weeks earlier, awarding nearly $30 million to a Holyoke family whose baby had suffered severe and permanent neurological injury at the hands of a doctor who had been negligent. The child was 11-year-old when the case went to trial.

Springfield Massachusetts Auto Accident Lawyer

Springfield’s major roads are Interstate 91 and Interstate 291, which connects to the Mass Pike. Within the city, Route 5 runs along the Connecticut River. Cars can pass over the river on the Memorial Bridge and North End Bridge.

Springfield’s most dangerous intersections for car accidents are Boston Road and Parker Street, Bridge Street and East Main Street (Route 141), Boston and Pasco roads and Allen and Cooley Streets, according to a Pioneer Valley Planning Commission analysis published by a local newspaper.

The commission reported the Boston Road and Parker Street intersection was the busiest in Western Massachusetts in 2007-2009, with 50,000 cars passing through each day.

Springfield has seen serious commercial truck and tractor-trailer accidents which have killed drivers, pedestrians and cyclists. In February 2017, the 31-year-old driver of a passenger vehicle was killed when a U.S. Foods tractor-trailer pulled onto Cottage Street. In July 2017, a cyclist died when a tractor-trailer struck him on Page Boulevard near Brookdale Drive.

Housing and Property Related Accidents

According to the U.S. Census, 52 percent of Springfield housing units are rentals. There have been a number of cases when landlords have failed to maintain a property in a safe and reasonable manner and put tenants at risk.

We saw this in Holyoke in January 2017, when a mother was forced to drop her 2-year-old daughter out a third-floor window to escape a fast-moving fire. Good Samaritans caught the child in a blanket while the woman made the same distressing jump. The woman and her husband suffered multiple injuries, including burns and spinal fractures.

Investigators say the building did not have a sprinkler system and the building alarm system stopped working. In March 2017, the family filed a negligence lawsuit against the building owner, his investment company and Works Management Services, a property management company based in Springfield.

Springfield Dog Bite Lawyers

More recently in 2016, a Springfield Shar pei allegedly struck two dogs and bit the man walking them on Central Street. The city wanted to euthanize the dog, but the owner challenged the order in court and it was reversed.
