Motor Vehicle Accident Case Results

Motor Vehicle Accident - Bus Hits Pedestrian - $7.1 Million
In September 2005, an MBTA bus hit the 58-year-old plaintiff in a crosswalk in the South End of Boston. The woman was walking with a crossing signal and was nearly fully across the four-lane street when the MBTA bus hit her from behind. The MBTA argued the plaintiff was negligent for not getting out of the way of the bus. Plaintiff's injuries resulted in amputation and she is confined to a wheelchair for the rest of her life. At a two-week trial, the jury deliberated for two days and returned a verdict for the plaintiff. The jury found the MBTA 100% at fault and the amount of judgment was $7.1 million after the MBTA exhausted appeals.

Truck Accident - Tractor-Trailer Strikes Car - $3 Million
In February 2008, a tractor-trailer truck crossed over the center line and struck the vehicle operated by the 74-year-old plaintiff, who suffered massive orthopedic injuries, including a fractured right ankle and fractures over the left knee, left hip and shoulder. Plaintiff was hospitalized and in a rehab facility for three months. Plaintiff's attorney brought claims against the truck driver and the owner of the truck, a beverage distributor. The motor vehicle accident case was settled at mediation.

Car Accident - Truck Collides with Car Causing Injuries - $2.5 Million
Plaintiff was a California resident traveling in Massachusetts for business in September of 2007. His vehicle was struck from behind by an 18-wheel truck in Marlborough and propelled over a sidewalk. As a result of the car accident, the plaintiff, a health care consultant, suffered major orthopedic injuries and required an emergency spinal fusion. He later had to undergo a second spinal fusion in California. He also reported suffering from erectile disfunction, which his spine surgeon attributed to the car accident. After depositions in Florida, Tennessee and California, the defendant entered into a stipulation as to liability in the automobile accident. The case was settled prior to trial.

Automobile Accident - Chest Injuries, Wrongful Death - $1.8 Million
In August 2009, the 83-year-old plaintiff's vehicle was struck head on by another car. Plaintiff's chest hit the steering wheel in the car accident and he was admitted to a local hospital with serious personal injuries. Plaintiff - who had a history of pulmonary edema - died nine days later from respiratory distress syndrome. He left behind his 83-year-old wife, who suffered from advanced dementia. He was her sole caregiver prior to the Massachusetts car accident and she subsequently had to be moved to an assisted living facility. Settlement in the wrongful death case was reached prior to trial.

Car Accident - Multiple Fractures - $1.725 Million
A former minor hockey league player was seriously injured in a car accident on Interstate 84 in Western Massachusetts. He and four other men had traveled to Massachusetts from New York State for a skiing trip. They came upon a driver who fell asleep at the wheel and lost control of his vehicle, striking the plaintiff's vehicle. The plaintiff was hospitalized after the car accident and required a spinal fusion and multiple surgeries for a forefoot fracture-location and temporomandibular joint syndrome (TMJ) as well as several other fractures.
